Terms of Service
Last updated: October 21, 2026.
These Terms of Service (the "Terms") are a legal agreement between
you and Aeroswipe LLC, a Wyoming limited liability company
("Aeroswipe," "we," "us," "our"), the operator of the
Should You Bid service at shouldyoubid.com (the "Service"). By using
the Service you agree to these Terms.
Please read these Terms carefully. They include a mandatory binding arbitration clause and class-action waiver in Section 14, a broad limitation of liability in Section 10, and an indemnification obligation in Section 11. Section 5 explains, in plain terms, the most important thing about this Service: what we sell you is an opinion, not a valuation you can rely on.
1. Acceptance of these Terms
You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a company, you represent that you are authorized to bind it, and "you" means that company.
If you do not agree to these Terms, do not use the Service.
2. What the Service is
The Service does two things.
A bid analysis. You give us the web address of a vehicle listing. We read that page and publicly available information about comparable sales, and we produce a written bid analysis report: an estimated fair value range, a suggested bid, a walk-away figure, observations drawn from the listing's text, its photographs and its comment thread, and the comparable sales the analysis reasoned from.
A car search. You describe a vehicle you are looking for. We search publicly available listings on third-party sites, and we produce a written car search report: a shortlist of listings that appear to match, statistics describing the listings we found, an estimate of what each shortlisted vehicle appears to be worth, general information about the model and model years in question, and observations drawn from the photographs in those listings.
Both kinds of report are generated by automated systems, including large language models. No human reviews a report before you receive it. No mechanic, appraiser, inspector or other professional examines any vehicle, and we never take physical possession of or inspect any vehicle.
We are not a broker, dealer, agent or intermediary. We do not sell vehicles, we have no relationship with the sellers whose listings we surface, we receive nothing from them, and we are not party to any transaction you enter into. A listing appearing in a report is not a recommendation that you buy it, an endorsement of its seller, or any representation that it exists, is available, is accurately described or is lawfully offered.
We read listings from a limited set of auction and classified sites. Some sites cannot be read, and which sites work may change without notice. If we cannot read a listing you submit, we will tell you so and you will not be charged.
3. Accounts
You need an account to use the Service. You are responsible for your
credentials and for everything done through your account. Give us
accurate information and keep it current. Tell us promptly at
support@shouldyoubid.com if you believe your account has been
compromised.
One free bid analysis per account. There is no free car search. Creating additional accounts to obtain additional free reports is a breach of these Terms, and we may refuse service, withhold reports, or close the accounts involved.
4. Payments, credits and refunds
- Price. After the free bid analysis, each bid analysis costs $3.00 USD and each car search costs $7.00 USD. Credits may be sold in packs; current prices are shown at checkout before you pay.
- Two kinds of credit. Report credits and car searches are separate balances and are not interchangeable: a report credit cannot be used to run a car search, and a car search cannot be used to run a bid analysis. Both are shown on your account page.
- One-time charges. The Service has no subscription and nothing renews automatically. You are charged only when you choose to buy.
- Payment processing. Payments are handled by Stripe. We do not receive or store your full card number. Your use of Stripe is subject to Stripe's own terms and privacy policy.
- Credits. Purchased credits do not expire and have no cash value. They are not transferable and are not redeemable for cash.
- When a credit is consumed. A credit is consumed when a report is successfully generated. If the analysis fails, or we cannot read the listing, no credit is consumed. A car search that finds no matching listings is refunded to your balance.
- Re-reading something you already paid for. Viewing a report you have already generated is free. If the auction has moved on and you ask us to revise an existing report, that revision may consume a credit; we will tell you before it does. Re-running a car search with the same brief is free; changing the vehicle, budget, mileage ceiling or search radius makes it a different search, which is charged.
- Refunds. Generating a report or running a search consumes computing resources immediately and cannot be undone, so purchases are final and non-refundable once the report has been generated. Unused credits and unused searches may be refunded at our discretion. Nothing here limits any refund right you have that cannot be waived under the law where you live.
5. What a report is not (please actually read this)
A report is an estimate and an opinion. It is not an appraisal, a valuation, an inspection, a guarantee, or financial or investment advice. This applies to both a bid analysis and a car search. Specifically:
- It is not an appraisal. We are not licensed or certified appraisers, and a report is not prepared under USPAP or any other appraisal standard. Do not present a report to an insurer, a lender, a court or a tax authority as an appraisal.
- It is not an inspection. Nobody looks at the car. A report reasons from photographs, written descriptions and comments supplied by a seller we do not know and cannot verify. A report cannot detect undisclosed damage, title problems, odometer fraud, misrepresentation, or any defect the seller did not photograph or mention. A pre-purchase inspection by a qualified mechanic is not something a report replaces.
- It is not a prediction you can rely on. Auction outcomes turn on reserve prices, bidder behaviour, timing, fees and conditions we cannot see. A car may sell far above or far below any figure in a report.
- It may be wrong. The underlying information may be inaccurate, incomplete or stale, and automated analysis makes mistakes, including confident ones. We do not warrant that any figure, fact, comparable sale or observation in a report is accurate.
- The decision is yours. You alone decide whether to bid, how much to bid, and whether to buy. You assume all risk of that decision and of any financial loss arising from it.
And specifically for a car search:
- Asking prices are not sold prices. A car search reports what sellers are asking. What comparable vehicles have actually sold for is a different figure.
- We do not read vehicle history reports. We cannot see a Carfax, AutoCheck or equivalent record, and a report never implies that we have. Where history decides the question, a report tells you which record to obtain yourself.
- Information about a model is general, not about that car. Known
faults, repair costs and recall history describe a generation of
vehicle, not the specific vehicle in a listing, and may be
incomplete or wrong. Recalls must be checked against the VIN with
the manufacturer or at
nhtsa.gov. - Listings change and disappear. A vehicle may be sold, withdrawn, repriced or misdescribed between our search and your enquiry. We do not verify that any listing is genuine, and some listings on classified sites are fraudulent. Never send money or a deposit to a seller you have not met for a vehicle you have not seen.
6. Acceptable use
You agree not to:
- submit listings by automated means, in bulk, or at a rate intended to burden the Service;
- resell, syndicate, publish or redistribute reports, or make them available as a product or service to others;
- use reports or any part of the Service to train, fine-tune or evaluate a machine learning model;
- scrape, mirror or systematically extract the Service or its output;
- attempt to circumvent usage limits, metering, payment, or the free report allowance;
- probe, scan or test the security of the Service, or interfere with its operation;
- use the Service for anything unlawful, or to infringe anyone's rights.
7. Third-party listings and sites
Listings are published by third parties on sites we do not operate or control. We are not affiliated with, endorsed by, sponsored by, or partnered with Bring a Trailer, Cars & Bids, or any other auction site, marketplace, manufacturer or marque. Their names and marks belong to their respective owners and are used only to identify the source of a listing or a vehicle, which is nominative fair use.
We do not warrant that any third-party site will remain readable, and we may add or remove supported sites at any time. Your use of those sites is governed by their own terms.
8. Your content and our content
You keep whatever rights you have in the URLs and notes you submit. You grant us a licence to use them to operate the Service and to produce your reports.
Reports are our copyrighted work. On payment, we grant you a personal, non-exclusive, non-transferable licence to use the report for your own vehicle purchasing decisions, including sharing it with your own mechanic, inspector or advisor. That licence does not permit the redistribution described in Section 6.
Reports quote and summarise material from third-party listings for
purposes of comment and analysis. If you own copyright in material you
believe has been used improperly, write to
support@shouldyoubid.com with enough detail to identify the material and
the listing, and we will review it and remove or alter what is
warranted.
9. Availability and changes
We may change, suspend or discontinue any part of the Service at any time. We may impose or change usage limits. We will not knowingly remove access to reports you have already paid for without notice, but we do not guarantee that reports are retained indefinitely; export anything you want to keep.
10. Disclaimer of warranties; limitation of liability
The Service and all reports are provided "AS IS" and "AS AVAILABLE," without warranty of any kind, express or implied. Aeroswipe LLC disclaims all warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranty that the Service will be uninterrupted, timely, secure or error free.
To the maximum extent permitted by law, Aeroswipe LLC and its officers, directors, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any lost profits, lost savings, lost opportunity, loss of data, or the price paid for or value of any vehicle, arising out of or related to the Service or any report, whether in contract, tort, strict liability or any other theory, even if advised of the possibility.
Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) fifty US dollars ($50).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. In that case our liability is limited to the fullest extent permitted by law.
11. Indemnification
You agree to defend, indemnify and hold harmless Aeroswipe LLC and its officers, directors, employees, contractors and agents from any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of your use of the Service, your breach of these Terms, or any vehicle you did or did not buy.
12. Termination
You may stop using the Service and close your account at any time by
writing to support@shouldyoubid.com. We may suspend or terminate your
access if you breach these Terms or if we reasonably believe your use
harms the Service or another user. Unused credits may be refunded at
our discretion on termination without cause.
Sections 5, 6, 8, 10, 11, 13, 14 and any provision that by its nature should survive, survive termination.
13. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules. Subject to Section 14, the state and federal courts located in Wyoming have exclusive jurisdiction.
14. Mandatory binding arbitration; class-action waiver
Please read this section carefully. It affects your legal rights.
Any dispute, claim or controversy arising out of or relating to these Terms or the Service (a "Dispute") will be resolved by binding individual arbitration, not in court, except that either party may bring an individual claim in small-claims court.
The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator. It may be conducted on documents, by video conference, or in the county where you live. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.
Class-action and jury-trial waiver. Disputes will be arbitrated only on an individual basis. You and Aeroswipe LLC waive any right to a jury trial and waive any right to participate as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate more than one person's claims. If this waiver is found unenforceable as to a particular claim, that claim proceeds in court and the rest remain in arbitration.
30-day right to opt out. You may opt out of this arbitration
agreement within 30 days of first accepting these Terms by emailing
support@shouldyoubid.com with the subject line "Arbitration Opt-Out" and
stating your name and the email address on your account. Opting out
does not affect any other part of these Terms.
15. Changes to these Terms
We may update these Terms. If we make a material change we will update the date at the top and, where we reasonably can, notify you. Your continued use after a change takes effect means you accept the revised Terms.
